Terms & Conditions

Last updated: [DATE] — draft, pending legal review

This is a template drafted to reflect the general requirements of UK consumer law (the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013) and standard practice for cross-border EU sales. It is not a substitute for advice from a qualified solicitor, and the highlighted placeholders should be completed and the whole document reviewed before the site goes live.

1. About us

This site, kallausdesign.com, is operated by [LEGAL BUSINESS NAME] ("Kallaus", "we", "us", "our"), of [REGISTERED OR TRADING ADDRESS], [if a registered company: a company registered in England and Wales under company number [NUMBER]]. You can contact us at hello@kallausdesign.com or +44 7783 008911. These terms apply whenever you use this site or place an order with us; by placing an order you agree to them.

2. Our products

We make each piece in small runs, so availability can be limited and a size or colour may sell out. We've made every effort to display colours and details accurately, but slight variation between what you see on screen and the finished garment is possible.

3. Prices and payment

All prices on this site are shown in Pounds Sterling (GBP). [confirm VAT position — e.g. "Prices include VAT where applicable" or remove this line if not yet VAT-registered] Payment is taken securely at checkout through Shopify and its payment partners; we do not see or store your full card details.

4. How a contract is formed

When you place an order, we will send you an email acknowledging we've received it — this acknowledgement does not mean your order has been accepted. A contract between us is only formed when we send you a separate confirmation that your order has been dispatched, or otherwise confirm acceptance in writing. We may decline or cancel an order, for example if an item is out of stock or priced incorrectly, in which case we'll notify you and refund any payment already taken.

5. Delivery

We aim to dispatch orders within [X working days]. Delivery times shown at checkout are estimates, not guarantees. Risk in the goods passes to you when they are delivered. If you are ordering from outside the United Kingdom, in particular from the European Union, your order may be subject to import duties, customs charges or local taxes on arrival, which are your responsibility and outside our control.

Your right to cancel (14-day cooling-off period)

If you are a consumer ordering from the UK or EU, you have a legal right to cancel your order for any reason, without needing to give one, within 14 days of receiving your goods. To cancel, tell us clearly — an email to hello@kallausdesign.com is enough. You then have a further 14 days to send the goods back to us. Once you've told us you're cancelling, we will refund you within 14 days of receiving the goods back (or of you providing evidence you've sent them), using the original payment method. Goods should be returned unworn, unwashed and with all tags attached; we may make a deduction if the value has been reduced by handling beyond what's needed to check the item, as the law allows. Unless an item is faulty, you are responsible for the cost of returning it.

Faulty or misdescribed goods

The cancellation right above is separate from, and doesn't reduce, your statutory rights under the Consumer Rights Act 2015 if an item is faulty, not as described, or not fit for purpose. In summary, and depending on how long you've had the item: you may be entitled to a full refund within the first 30 days; after that, to a repair or replacement; and, if that doesn't resolve things, to a price reduction or a final right to reject the goods. These rights exist regardless of anything else in these terms.

6. Intellectual property

The Kallaus name, logo, photography, garment designs and the content of this site belong to us or our licensors. You may not copy, reproduce or reuse them without our written permission.

7. Our liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or acting negligently, but we are not liable for losses that were not foreseeable, or for business losses if you are using the site for a purpose outside your normal personal use. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited or excluded.

8. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute, without prejudice to your right as a consumer to bring proceedings in your own country of residence, and to the protection given to you by any mandatory laws of that country that we cannot contract out of.

9. Complaints

If something's wrong, please contact us first at hello@kallausdesign.com so we can try to put it right. UK customers can also seek independent advice from Citizens Advice.

10. Changes to these terms

We may update these terms from time to time, for example as our processes or the law changes. The version that applies to your order is the one published on the site at the time you placed it.
